FINE ART COMMISSION INFO

These Terms of Service are relevant to Non-Commercial projects only, and are subject to revision without notice. The Client must read, understand and agree to all the below terms before entering into an agreement with the Artist (CM Pauluh\Nebulosus Severine).
- I (the artist) retain all creative rights to the commissioned artwork, including the rights to distribution (i.e., to create prints, merchandise, etc.) unless otherwise negotiated via contract with the client.
- I (the artist) retain the right to display all commissioned work on my personal website, gallery, blog, or other website.
- I (the artist) reserve the right to cancel a commission at any time due to extreme or unforeseen circumstances.
- These terms are subject to revision at any time.

What is a commission?
- A commission art or design work specifically requested by a client, and completed by an artist.
What kind of work can/will you do?
- I am open to attempting most things within reason. Most of the work I’ve done involves illustration in ink, marker, colored pencil, & charcoal; paintings in oil and/or acrylic; mixed media; digital composition, photo correction, photo retouch/restoration. Bear in mind that I reserve the right to refuse any commission request.
What kind of information is required from me as a client?
- Personal info: Name, email address, and phone number; if work is to be shipped, a shipping address.
- Commission info: Be as specific as possible in describing what you want. Artwork medium, size/dimensions, subject matter, color scheme, style. Provide visual references if possible.
How long will it take?
- Commissions are handled on a first come, first serve basis. Completion times are estimated based on the receipt of the commission agreement, the size and detail of the artwork, and the amount of conceptual planning required. Generally, most original artwork will take anywhere from 1 to 8 weeks from project start time.
How much will it cost?
- After consultation, I will make an estimate based on the cost of materials and anticipated time spent on the project. My current rate is $50/hour, which will include conceptual phase/planning/sketching. Shipping, if necessary, is an additional cost.
Example:
Cost of materials: $50 +
10 hours of work hours x $50 = $500 +
Shipping material: $20 +
Shipping: $25 -- Total = $570
What does “cost of materials” mean?
- The materials required to complete artwork. This may include canvas, paint, drawing materials, stock photography fees, etc.
What forms of payments do you accept?
- Payment will be made in U.S. dollars. I accept Paypal, cash, money order, and debit/credit cards (Mastercard, Visa, American Express, and Discover) (via Paypal).
How are payments arranged?
- Once the commission agreement is reached, a non-refundable deposit of 50% is required from the Client. When the project is completed and the customer is satisfied with the work, the remaining 50% is required before delivery.
Is there a contract involved?
- At this time, I am developing a contract for use with commercial artwork commissions. If you require one, I will draw one up at the beginning of the commission agreement.
Will I be able to see the work in process?
- Yes -- I generally take pictures of my art as I’m working on it, and will send you updates as desired, via email, text, or method of your choosing.
Can I alter your art after I receive it?
- You may resize/crop the commissioned artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but you are not allowed to alter the artwork itself. In all cases, you must display visible, written credit to me as the artist.
Can I use your art for commercial purposes?
- If you will be using the artwork for commercial purposes, you must inform me prior to the start of work. Commercial use of images will be decided upon on a case-by-case basis, and will result in an increased commission price. New terms of service must be decided upon before I begin any work on a commission for commercial use.
Can I resell your art?
- Digital artwork may not be resold in any way (including prints made of the work).
- Physical art may be resold, provided that 1.) ONLY the original piece is sold - NO copies/prints are to be made or sold; 2.) Credit is still given to me as the creator of the work.
Can I display your artwork on my website, blog, or other online gallery?
- You may exhibit my work in any online/offline art gallery, etc. provided that you give visible, written credit to me as the artist. You may absolutely not exhibit my artwork as your own or anyone else’s.
Can I get my money back?
- There are no refunds of the initial up-front 50%. If you are unhappy with the resulting artwork, I will negotiate to make reasonable changes to fix the problem to your satisfaction, but there are no refunds of the initial 50%. If alterations are made and you are still not satisfied, you will not be required to pay the other 50%, although I will retain the artwork to reuse or resell as I see fit.
How will my commissioned work be delivered to me?
- If the media is digital: It will be sent via email to your inbox. The remaining payment amount is expected before delivery time.
- If the media is a physical object: If you live in the Seattle/Tacoma area, I can make arrangements with you to meet and deliver your commission in person. Otherwise, your artwork will be shipped and insured via USPS, UPS, or your shipping agent of choice. Shipping and handling charges are an additional cost and are based on the size & weight of the package shipped. The remaining payment amount is expected at delivery time.
